1. CONSIDERAÇÕES INICIAIS

1. INITIAL CONSIDERATIONS

1.1 Estes Termos de Referência (TR) são publicados em língua portuguesa e em língua inglesa, formatada em duas colunas, a da esquerda em português e a da direita em inglês, sendo o texto em português o oficial.

1.1 These Terms of Reference (ToR) are published in Portuguese and English, formatted in two columns, the one on the left in Portuguese and the one on the right in English, with the text in Portuguese being the official one.

1.2 O Grupo de Estudos Misto (GEM) é uma modalidade de participação social prevista no Art. 12 da Instrução Normativa ANAC n° 154/2020, a qual estabelece as diretrizes e os procedimentos para o processo regulatório e a melhoria contínua da qualidade regulatória.

1.2 The Mixed Study Group (MSG) is a type of social participation provided for in Article 12 of ANAC Normative Instruction No. 154/2020, which establishes the guidelines and procedures for the regulatory process and the continuous improvement of regulatory quality.

1.3 Como resultado do tema 1 da Agenda Regulatória 2023-2024, sobre Dados da Certificação de Projeto Relevantes ao Ambiente Operacional, foram publicadas emendas aos Regulamentos Brasileiros de Aviação Civil (RBAC) n° 01, 21, 61 e 90, contendo novas regras sobre Dados Relevantes à Operação (Operational Suitability Data - OSD). Com as novas regras, em vigor a partir de 02/01/2025, os Dados Relevantes à Operação para Pilotos (Flight Crew Data - FCD), resultado da avaliação operacional de aeronaves, e a Lista Mestra de Equipamentos Mínimos (MMEL) foram incluídos ao Certificado de Tipo (CT).

1.3 As a result of theme 1 of the 2023-2024 Regulatory Agenda, on Type Design Data with Relevant Effects to the Operational Context, amendments to the Brazilian Civil Aviation Regulations (RBAC) no. 01, 21, 61 and 90 were published, containing new rules on Operational Suitability Data (OSD). With the new rules, effective on 02/JAN/2025, Flight Crew Data (FCD), result of the aircraft operational evaluation, and the Master Minimum Equipment List (MMEL) were included in the Type Certificate (TC).

1.4 Como parte das ações de implementação necessárias, serão editadas as Instruções Suplementares (IS) n° 21.61-001A, sobre FCD, e 21.61-005A, sobre MMEL, em substituição às IS n° 00-007A e 21-003A existentes sobre tais assuntos.

1.4 As part of the necessary implementation actions, Supplementary Instructions (IS) No. 21.61-001A, on FCD, and 21.61-005A, on MMEL, will be issued, replacing the existing IS No. 00-007A and 21-003A on such matters.

2. OBJETIVO

2. OBJECTIVE

2.1 O objetivo deste GEM é a discussão e coleta de contribuições sobre as minutas das IS n° 21.61-001A e 21.61-005A, permitindo aos participantes o debate dos conceitos e princípios que embasam o texto das IS.

2.1 The objective of this MSG is to discuss and collect contributions on the drafts of IS No. 21.61-001A and 21.61-005A, allowing participants to debate the concepts and principles that support the text of the IS.

2.2 Não faz parte do objetivo a proposição de minutas finais das IS, ainda que sugestões de correção ou ajustes possam ser submetidas pelos participantes. A análise final das contribuições e edição final da IS será realizada pela ANAC.

2.2 Proposing final drafts of the IS is not part of the objective, although suggestions for corrections or adjustments may be submitted by participants. The final analysis of contributions and the final edition of the IS will be carried out by ANAC.

3. COMPOSIÇÃO DO GRUPO DE ESTUDOS MISTO

3. COMPOSITION OF THE MIXED STUDY GROUP

3.1 O GEM contará com participação de servidores da ANAC (participantes internos) e organizações afetadas (participantes externos), desde que atendam aos critérios de elegibilidade.

3.1 The MSG will feature the participation of ANAC servants (internal participants) and affected organizations (external participants), provided they meet the eligibility criteria.

3.2 O GEM será dividido em dois painéis, que funcionarão separadamente:

a) Painel FCD; e

b) Painel MMEL.

3.2 The MSG will be divided into two panels, which will operate separately:

a) FCD Panel; and

b) MMEL Panel.

3.3 Para assegurar o bom funcionamento do GEM, a ANAC poderá limitar a quantidade de participantes externos se houver mais do que 10 (dez) organizações inscritas em um painel.

3.3 To ensure the proper functioning of the MSG, ANAC may limit the number of external participants if there are more than 10 (ten) organizations registered on a panel.

3.3.1 Caso ocorra limitação na quantidade de participantes externos, a seleção ocorrerá por painel e de acordo com os seguintes critérios:

a) Primeiramente, as organizações com histórico de interação junto à ANAC no tema do painel em processos de certificação ou validação de tipo anteriores; e

b) Em segundo estágio, por ordem de inscrição.

3.3.1 If there is a limitation on the number of external participants, the selection will be made by panel and in accordance with the following criteria:

a) Firstly, organizations with a history of interaction with ANAC on the panel topic in previous type certification or type validation processes; and

b) Secondly, in order of registration.

3.4 Critérios de Elegibilidade

3.4 Eligibility Criteria

3.4.1 Para ser elegível a participar do Painel FCD, a organização deve ser detentora ou requerente de um certificado de tipo para aeronave que requeira habilitação de tipo para pilotos segundo as regras do RBAC n° 61, §61.5(b)(3)(i) a (iv), isto é:

a) aeronaves certificadas para operação com tripulação mínima de 2 (dois) pilotos;

b) aeronaves com peso máximo de decolagem aprovado superior a 5.670 kg (12.500 lb), exceto balões livres e dirigíveis;

c) aviões com motor a reação; ou

d) aeronaves de sustentação por potência.

3.4.1 To be eligible to participate in the FCD Panel, the organization must be a holder or applicant for a type certificate for an aircraft that requires type rating for pilots under the rules of RBAC No. 61, §61.5(b)(3)(i) to (iv), i.e.:

a) aircraft certified for operation with a minimum crew of 2 (two) pilots;

b) aircraft with a maximum approved takeoff weight exceeding 5,670 kg (12,500 lb), except free balloons and airships;

c) jet engine airplane; or

d) powered lift aircraft.

3.4.2 Para ser elegível a participar do Painel MMEL, a organização deve ser detentora ou requerente de um certificado de tipo para aeronave que possua ou possuirá uma MMEL.

3.4.2 To be eligible to participate in the MMEL Panel, the organization must be the holder or applicant for a type certificate for an aircraft that has or will have an MMEL.

3.4.3 As organizações elegíveis podem designar até dois representantes para cada painel, desde que atendam aos seguintes critérios:

a) Possuam no mínimo 3 anos de experiência atuando tecnicamente no assunto do painel;

b) Estejam autorizados a se posicionar tecnicamente em nome da organização; e

c) Possuam proficiência no idioma inglês suficiente para discussão dos assuntos do painel.

3.4.3 Eligible organizations can appoint up to two representatives to each panel, provided they meet the following criteria:

a) Representatives have at least 3 years of experience working technically on the subject of the panel;

b) Representatives are authorized to express a technical position on behalf of the organization; and

c) Representatives have sufficient English proficiency for discussion of panel topics.

3.4.4 Um mesmo representante poderá participar de ambos os painéis, desde que atenda aos critérios de elegibilidade acima.

3.4.4 The same representative may participate in both panels, provided he or she meets the eligibility criteria above.

3.5 Processo seletivo

3.5 Selection process

3.5.1 A seleção de organizações participantes ocorrerá de acordo com as seguintes etapas e cronograma estimado:

a) Inscrição e indicação de representantes: da data de publicação deste Edital até 30/06/2024;

b) Decisão quanto à aceitação das inscrições ou indicações pela ANAC: Até 12/07/2024;

c) Submissão de recurso quanto ao indeferimento de inscrição da organização ou indicação de representante: até 10 dias após o indeferimento; e

d) Divulgação da lista de organizações participantes: até 31/07/2024.

3.5.1 The selection of participating organizations will occur according to the following steps and estimated schedule:

a) Registration and appointment of representatives: from the date of publication of this Notice until 30/JUN/2024;

b) Decision regarding the acceptance of registrations or appointments by ANAC: Until 12/JUL/2024;

c) Submission of an appeal regarding the rejection of the organization's registration or designation of a representative: up to 10 days after the rejection; and

d) Publication of the list of participating organizations: until 31/JUL/2024.

3.5.2 A inscrição deverá ser realizada preenchendo o formulário eletrônico disponível no endereço https://pesquisas.anac.gov.br/index.php/534461?lang=pt-BR. O preenchimento deverá ser realizado por pessoa da organização com poderes para representá-la junto à ANAC. Alternativamente, poderá ser anexado no formulário documento assinado por pessoa com tais poderes.

3.5.2 Registration must be completed by filling out the electronic form available at https://pesquisas.anac.gov.br/index.php/534461?lang=en. The form must be completed by a person from the organization with powers to represent it before ANAC. Alternatively, a document signed by a person with such powers may be attached to the form.

3.5.3 A confirmação ou rejeição das inscrições será comunicada ao e-mail da organização informado durante a inscrição, e divulgada na página https://www.gov.br/anac/pt-br/acesso-a-informacao/participacao-social/outros-instrumentos-de-participacao-social, na área específica deste GEM (daqui em diante referenciada como Página do GEM).

3.5.3 Confirmation or rejection of registrations will be communicated to the organization's email address provided during registration, and published on the page https://www.gov.br/anac/pt-br/acesso-a-informacao/participacao-social/outros-instrumentos-de-participacao-social, in the specific area of this MSG  (hereinafter referred to as the MSG Page).

3.5.3 A submissão de recurso poderá ser realizada, no prazo estabelecido acima, através do e-mail gtni.sar@anac.gov.br.

3.5.3 Appeals can be submitted, within the deadline established above, via email gtni.sar@anac.gov.br.

3.5.4 A lista final de organizações participantes e do resultado da análise dos recursos será comunicada por e-mail às organizações inscritas e será divulgada na Página do GEM.

3.5.4 The final list of participating organizations and the results of the appeal analysis will be communicated by email to the registered organizations and will be published on the MSG Page.

4. FUNCIONAMENTO DO GEM

4. OPERATION OF THE MSG

4.1 O GEM ocorrerá no período de 01/08 a 30/09/2024, por meio de atividades assíncronas e reuniões on-line. O GEM poderá ser encerrado antecipadamente caso não existam mais assuntos a serem debatidos.

4.1 The MSG will take place from 01/AUG to 30/SEP/2024, through asynchronous activities and online meetings. The MSG may be closed earlier if there are no more topics to be discussed.

4.2 Somente organizações e representantes aceitos poderão participar do GEM.

4.2 Only accepted organizations and representatives will be allowed to participate in the MSG.

4.3 Os participantes inscritos se comprometem cumprir as condições de funcionamento do GEM contidas nestes Termos de Referência.

4.3 Registered participants undertake to comply with the MSG operating conditions contained in these Terms of Reference.

4.4 Representantes de organizações poderão ser removidos do GEM caso não respeitem as condições de funcionamento, se comportem de forma desrespeitosa perante os demais participantes, ou insista em discussões além do escopo e objetivo do GEM, e caso a ANAC avalie que a continuidade daquele representante seja prejudicial ao funcionamento do GEM. Nesse caso, será dada oportunidade para que a organização indique outro representante que atenda aos critérios de elegibilidade.

4.4 Representatives of organizations may be removed from the MSG if they do not respect the operating conditions, behave disrespectfully towards other participants, or insist on discussions beyond the scope and objective of the GEM, and if ANAC considers that the continuation of that representative would be harmful to the operation of MSG. In this case, the organization will be given the opportunity to appoint another representative who meets the eligibility criteria.

4.5 O GEM será realizado no idioma Inglês.

4.5 The MSG will be carried out in English.

4.6 As atividades assíncronas incluem a avaliação das minutas de IS, realização de comentários a respeito de pontos a serem discutidos ou alterados, bem como o atendimento de ações acordadas entre os participantes nas reuniões on-line.

4.6 Asynchronous activities include the evaluation of IS drafts, commenting points to be discussed or changed, as well as compliance with actions agreed between participants during online meetings.

4.7 As reuniões on-line servirão para discutir os pontos mais importantes identificados nas atividades assíncronas, especialmente aqueles em que exista divergência de posicionamento entre participantes ou com o posicionamento da ANAC.

4.7 Online meetings will serve to discuss the most important points identified in asynchronous activities, especially those in which there is a divergence of position between participants or with the position of ANAC.

4.8 As reuniões de cada painel ocorrerão a cada duas semanas, preferencialmente entre 14:00 UTC e 16:00 UTC, exceto se não houver evolução na avaliação de assuntos discutidos. Poderão ser agendadas reuniões adicionais, mediante necessidade. As reuniões dos painéis de FCD e MMEL ocorrerão em dias distintos.

4.8 Meetings of each panel will take place every two weeks, preferably between 14:00 UTC and 16:00 UTC, unless there is no progress in the assessment of discussed issues. Additional meetings may be scheduled as necessary. The FCD and MMEL panel meetings will take place on different days.

4.9 As atividades assíncronas serão documentadas através dos comentários recebidos nas minutas, enquanto as reuniões serão documentadas por Registro de Reunião emitido pela ANAC.

4.9 Asynchronous activities will be documented through comments received on the draft documents, while meetings will be documented by a Meeting Record issued by ANAC.

4.10 Como resultado do GEM, a ANAC emitirá um relatório contendo as contribuições recebidas e as principais discussões realizadas, o qual será divulgado na Página do GEM, em até 10 (dez) dias úteis após sua conclusão.

4.10 As a result of the MSG, ANAC will issue a report containing the contributions received and the main discussions held, which will be published on the MSG Page, within 10 (ten) business days after its conclusion.

4.11 As discussões do GEM serão levadas em consideração na elaboração final das IS. Todavia, a ANAC terá posição final no texto da IS, podendo diferir das contribuições recebidas.

4.11 MSG discussions will be taken into account in the final preparation of the IS. However, ANAC will have a final position on the text of the IS, which may differ from the contributions received.

4.12 Em atendimento ao Art. 13 da Instrução Normativa n° 154/2020, os documentos que compões o processo normativo serão classificados como preparatórios e mantidos com restrição de acesso até a publicação das IS. Após, serão tornado públicos, exceto se possuírem motivação específica para a restrição de acesso. No caso de justificativas que ocorram por meio de documentos restritos, os mesmos poderão ser enviados com ressalva expressa da organização participante quanto à restrição das informações.

4.12 In compliance with Article 13 of Normative Instruction No. 154/2020 , the documents that compose the normative process will be classified as preparatory and kept with restricted access until the publication of the IS. Afterwards, they will be made public, unless there is a specific reason for restricting the access. In the case of justifications that occur through restricted documents, they may be sent with express notice from the participating organization regarding the restriction of information.

4.13 Será utilizado como ferramenta para as discussões e reuniões o Microsoft Teams. É responsabilidade do participante externo possuir acesso ao software, que não será fornecido pela ANAC.

4.13 Microsoft Teams will be used as a platform for discussions and meetings. It is the responsibility of the external participant to have access to the software, which will not be provided by ANAC.

4.14 Casos omissos ou situações particulares não cobertas nestes Termos de Referência serão decididos pela Gerência Técnica de Normas e Inovação (GTNI) da Superintendência de Aeronavegabilidade.

 4.14 Omitted cases or specific conditions not covered in these Terms of Reference will be decided by the Airworthiness Standards and Innovation Technical Branch (GTNI) of the Department of Airworthiness.
