International Air Services - Market Access Authorization

The operation of international air services is based on the traffic rights negotiated in the Air Services Agreements (ASA) between the different countries and Brazil.

The summary of the Agreements is available for consultation here.

The Air Service Agreements define which traffic rights the countries will grant to each other for airline operations.

The traffic rights described in the agreements generally refer to scheduled operations between countries.

For non-scheduled operations it should be checked whether the agreements specifically mention which traffic rights will be granted. If the Agreement has specific information on traffic rights for non-scheduled operations, operations that comply with these limits will be considered as “normal” and may be registered directly in SIROS. If the Agreement does not mention rights for non-scheduled operations, only operations under third freedom of the air will be considered “normal”.

If a foreign company intends to conduct a non-scheduled operation with traffic rights not provided in the Air Services Agreement, such operation will be considered an exception or “waiver”. This type of operation requires prior authorization to register. To do so, the company must submit a “Market Access Authorization Application” through SEI.

To submit the request, the company’s representative must access SEI-ANAC, choose to open a new process of type “Market Access Authorization”, then choose to add a new document of type  “Market Access Form”, fill the form with the required information and then attach the proof of payment of the due tax.

Only after approval of the request the operation can be registered in SIROS.
